Welcome to Brightly.
These Terms of Use and Account Terms ("Terms") govern your access to and use of the Brightly website, platform, account services, tuition centre directory, educational resources, booking assistance services and other services made available by Brightly (collectively, the "Services").
In these Terms, "Brightly", "we", "us" and "our" refer to Brightly.
"User", "you" and "your" refer to any person accessing or using Brightly, including parents and guardians who create a Brightly account or request assistance with a tuition centre booking.
By creating a Brightly account, accessing the Services or otherwise indicating your acceptance of these Terms, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, you should not create an account or use the Services.
Brightly is an online platform designed to help parents and guardians discover and connect with tuition centres in Singapore.
Among other things, Brightly may:
Unless expressly stated otherwise, Brightly does not itself operate the tuition centres listed on the Platform and does not provide the tuition classes offered by those tuition centres.
The tuition centre is responsible for providing the tuition or educational service booked by the parent or guardian.
Brightly accounts intended for booking tuition services should be created and managed by a parent, legal guardian or other adult authorised to make decisions for the relevant student.
You must be at least 18 years old to create an account for the purpose of requesting or arranging tuition services through Brightly.
When creating an account, you agree to provide information that is accurate, current and complete.
You are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account.
You must notify Brightly promptly if you believe your account has been accessed or used without your permission.
Brightly may request additional information where reasonably necessary to verify your identity, protect an account, investigate suspected misuse or facilitate a requested Service.
Where you provide Brightly with information relating to a child or student, you confirm that you are the child's parent, legal guardian or otherwise authorised to provide that information to Brightly.
Brightly will only collect, use and disclose personal information in accordance with its Privacy Policy and applicable Singapore data protection laws.
Where reasonably necessary to process a tuition enquiry or booking request, relevant information about the parent, guardian or student may be provided to the tuition centre selected by you.
You should not provide Brightly with personal information about a child that is unnecessary for the Service you are requesting.
Brightly may provide users with complimentary educational materials including, without limitation:
Where you request a resource to be delivered by email, you authorise Brightly to use the email address you provide for the purpose of delivering that resource and communications reasonably necessary to provide it.
Unless otherwise stated, Brightly's educational materials are provided for personal and non-commercial educational use.
You may download and use materials for your own or your child's personal study purposes, but you must not reproduce, sell, republish, distribute or commercially exploit Brightly's proprietary materials without our prior written permission.
Brightly makes reasonable efforts to provide useful and accurate educational information. However, educational resources are provided as supplementary revision materials and are not a substitute for official examination materials, school instruction or professional educational advice.
Brightly does not guarantee any particular examination score, academic improvement or educational outcome arising from the use of its materials.
Brightly may offer users the option to receive emails containing:
Where required, Brightly will obtain your consent before using your personal data to send marketing or promotional communications.
You may withdraw your consent to receive optional marketing or newsletter communications at any time through the unsubscribe facility contained in our emails or by contacting Brightly.
Unsubscribing from optional marketing or newsletter communications does not necessarily prevent Brightly from sending you communications that are required to administer your account or provide a Service that you have requested.

Brightly takes reasonable steps to maintain useful and current information but does not guarantee that every listing will always be complete, accurate or up to date.
Tuition centre fees, schedules, teachers, class availability, promotions and other details may change without Brightly being notified immediately.
Users should review material information with the relevant tuition centre before committing to a class.
The inclusion of a tuition centre on Brightly does not, by itself, mean that:
Any particular verification, partnership, sponsorship or accreditation displayed on Brightly will only have the meaning expressly described on the Platform.
Users should conduct their own assessment of whether a tuition centre is appropriate for their child.
Brightly welcomes corrections to tuition centre listings.
Tuition centres may contact Brightly where they believe information displayed about their centre is inaccurate, incomplete or outdated.
Brightly may amend, update or remove information where we reasonably believe a correction is appropriate.
Brightly may also contact tuition centres to verify information displayed on the Platform.
A tuition centre claiming a listing does not necessarily mean that information displayed before the claim was supplied or approved by that tuition centre.
Where a listing has been verified or managed directly by the tuition centre, Brightly may identify this on the Platform.
Certain names, trademarks, logos, photographs, descriptions and other materials displayed in connection with tuition centres may belong to the relevant tuition centre or another third party.
Displaying such material does not transfer ownership of that material to Brightly.
Where a rights holder reasonably believes that material displayed on Brightly infringes its intellectual property rights, it may contact us at brightlytutorzone@gmail.com with sufficient information for us to investigate the request.
Brightly may remove, replace or restrict access to material while such a request is being reviewed.
Brightly may allow authorised representatives of tuition centres to claim an existing listing.
By submitting a claim, the person making the claim confirms that they are authorised to act on behalf of the relevant tuition centre.
Brightly may request information or documentation reasonably necessary to verify the claim.
Submission of a claim does not guarantee that Brightly will approve it.
Once a listing has been successfully claimed, the tuition centre may be permitted to manage or provide certain information relating to its listing.
Tuition centres are responsible for ensuring that information they provide to Brightly is accurate and not misleading.
Additional terms, including Brightly's Tuition Centre Partner Terms, may apply to tuition centres that claim listings, manage their profiles or accept bookings through Brightly.
Where there is any inconsistency between these Terms and the applicable Tuition Centre Partner Terms in relation to a tuition centre's use of Brightly, the Tuition Centre Partner Terms will prevail to the extent of that inconsistency.
Brightly may provide a concierge-style booking service that allows parents and guardians to request assistance in arranging tuition classes.
When you submit a booking request, you authorise Brightly to contact you using the contact information you have provided for purposes connected with your request.
Brightly may communicate with you by email, telephone, SMS, WhatsApp or another communication channel you have provided or used to communicate with us.
These communications may include questions about:
Communications relating solely to an enquiry or booking requested by you are service communications rather than an agreement by you to receive unrelated marketing communications.
Submitting a booking request through Brightly does not automatically mean that a tuition class has been reserved or confirmed.
A booking is only confirmed once the relevant tuition centre has accepted the booking and confirmation has been communicated to you by Brightly or the tuition centre.
Availability displayed or communicated before confirmation is indicative and may change.
Brightly may contact the tuition centre on your behalf to:
Brightly cannot guarantee that a tuition centre will accept a booking request.
Unless expressly stated otherwise for a particular Service:
The tuition centre is the provider of the tuition or educational service and Brightly acts as an intermediary facilitating the connection and booking between the parent or guardian and the tuition centre.
Once a tuition booking is accepted, the tuition service is provided by the tuition centre in accordance with the tuition centre's applicable terms, policies and arrangements.
Brightly does not employ or supervise the teachers or tutors of independently operated tuition centres.
Brightly is not responsible for controlling how a tuition centre conducts its classes, determines its curriculum, selects its teachers or assesses students.
Nothing in these Terms prevents Brightly from providing separate services directly to users where those services are expressly identified as being provided by Brightly.
Brightly may display prices provided by tuition centres or obtained from information reasonably believed to be current.
Prices may be expressed per lesson, month, term, programme, package or using another pricing structure.
Before confirming a booking, users should review the final applicable price and any additional fees communicated by Brightly or the tuition centre.
Where Brightly becomes aware that displayed pricing is materially inaccurate, we may correct the listing.
A pricing error does not require a tuition centre to provide a service at an obviously incorrect price, subject always to applicable Singapore law and consumer rights.
Where Brightly facilitates payments in the future, additional payment and refund terms may be presented to you before payment.
Different tuition centres may maintain different policies relating to:
Where these terms are material to a booking, Brightly will endeavour to make the relevant information available or communicate it during the booking process.
The applicable tuition centre remains responsible for its own policies unless Brightly expressly states otherwise.
You should review those policies before confirming your enrolment.
Where a booking is made directly with a tuition centre, cancellation and refund rights may be governed by the tuition centre's applicable terms and policies.
Brightly may assist parents and tuition centres in communicating about cancellations, changes or disputes but does not guarantee the outcome of any dispute involving an independently operated tuition centre.
Where Brightly itself collects payment, charges a Brightly fee or provides a separately paid service, any applicable cancellation or refund terms will be disclosed before the relevant transaction.
Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded under Singapore law.
Where you request information about or a booking with a particular tuition centre, you authorise Brightly to disclose information reasonably necessary to facilitate that request to the relevant tuition centre.
This may include information such as:
Personal data will be handled in accordance with Brightly's Privacy Policy.
Once your information has been provided to an independently operated tuition centre, that tuition centre may also have its own obligations regarding the handling of your personal information.
When using Brightly, you must not:
Except for material belonging to tuition centres, users or other third parties, Brightly and its licensors retain all applicable rights in the Platform and Brightly content, including its:
No provision of these Terms transfers ownership of Brightly's intellectual property to you.
You are granted a limited, revocable, non-exclusive and non-transferable right to access and use Brightly for personal and lawful purposes in accordance with these Terms.
Brightly may contain links to websites or services operated by tuition centres or other third parties.
Brightly does not control all third-party websites and is not responsible for their independent content, privacy practices, security or terms.
Your use of a third-party service may be subject to separate terms between you and that provider.
We aim to keep Brightly available and functioning properly but do not guarantee uninterrupted or error-free access.
Brightly may occasionally be unavailable because of:
We may modify, suspend or discontinue features where reasonably necessary.
Brightly is intended to assist users in finding and comparing educational services.
Brightly does not guarantee that any particular tuition centre, teacher, programme or teaching method will be appropriate for every student.
Academic performance depends on numerous factors outside Brightly's control.
Users remain responsible for assessing the suitability of a tuition centre before enrolling their child.
Where Brightly has not independently verified information supplied by or relating to a tuition centre, Brightly does not represent that such information has been independently verified.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by Singapore law.
To the extent permitted by law, Brightly will not be responsible for losses arising solely from the acts or omissions of an independently operated tuition centre, including matters concerning:
This does not exclude responsibility that Brightly may have for its own acts or omissions where liability cannot lawfully be excluded.
Users should contact Brightly promptly if they experience a problem involving a booking made through the Platform so that we can reasonably assist in resolving the matter.
Brightly may restrict, suspend or terminate an account where we reasonably believe that:
Where reasonably practicable, we may provide notice before terminating an account.
You may stop using Brightly at any time and may request closure of your account by contacting us.
Closure of an account does not automatically require Brightly to erase information that we are permitted or required to retain for legitimate business, dispute-resolution or legal purposes.

Brightly handles personal data in accordance with its Privacy Policy and applicable Singapore data protection laws.

Brightly may amend these Terms from time to time to reflect:
Where a change is material, we will take reasonable steps to notify affected users, such as by displaying a notice on Brightly or sending a notification to the email address associated with the user's account.
The effective date shown at the beginning of these Terms indicates when the latest version takes effect.
Continued use of Brightly following the effective date of updated Terms constitutes acceptance of the updated Terms where permitted by law.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
If Brightly does not immediately enforce a provision of these Terms, this does not mean that Brightly has waived its right to enforce that provision later.
These Terms, together with our Privacy Policy and any additional terms expressly applicable to a particular Service or transaction, constitute the agreement governing your use of Brightly.
These Terms are governed by the laws of the Republic of Singapore.
Subject to any rights or remedies available to consumers under applicable law, the courts of Singapore will have jurisdiction in relation to disputes arising from or connected with these Terms or the use of Brightly.
